Initiatives, Referendums and Referrals

There are 3 kinds of petitions: Initiatives, Referendums and Referrals (For more information and a complete definition, this Link opens a new tab.)

Go here (Link new tab) to SEARCH the 2022 Initiatives, Referendums and Referrals (IRR) database for this year’s ballot. This is where you can look up the current status of all petitions. On the IRR database Search page: select the Election Year, “Qualified to ballot” and Summary Results.

The following information is based on today’s date: October 9, 2022.

For our November, 2022 ballot there have been 57 Initiatives filed. Of these only 8 have been approved as of today: 1, 3, 6, 13, 14, 17, 18, and 35. Some have been withdrawn. Look them up in the IRR database.

A Referendum Petition can only be filed in response to legislative action in the last session. If a bill had an “Emergency Clause” it cannot be reversed by the Referendum process. There were three filed: 301, 302, and 303 but “09/24/2021 Signatures were not turned in for verification by the deadline.” Therefore, there are no Referendums filed for the 2022 ballot.

There are 2 Referral Petitions: 401 (Measure 111 on the ballot) and 402 (Measure 112 on the ballot).

Measure 111: Amends Constitution: State must ensure affordable healthcare access, balanced against requirement to fund schools, other essential services
Result of “Yes” Vote: “Yes” vote requires state to ensure affordable healthcare
access. State must balance healthcare funding against funding for schools, other essential services; courts must respect balance.
Result of “No” Vote: “No” vote retains current law. The constitution does not
require the state to ensure access to affordable health care; state provides some healthcare access.

Measure 112: Amends Constitution: Removes language allowing slavery and involuntary
servitude as punishment for crime

Result of “Yes” Vote: “Yes” vote amends constitution to remove language allowing slavery and involuntary servitude as punishment for crime; allows programs to
be ordered as part of sentencing.
Result of “No” Vote: “No” vote retains current language that generally prohibits
slavery and involuntary servitude but allows slavery and involuntary servitude as
punishment for crime.

For example: for the 2024 election there have been 16 Initiative Petitions filed, among which are:

MarcThielman filed 2024-001 which failed – “01/19/2022 Rejected based on the advice from the Attorney General​​​”

Marc Thielman, Donna Kreitzberg and Kimberly Gubala have filed the following two (so far) successful Initiative Petitions: 2024-005 and 2024-006. (You can track their progress at the 2024 site.) Both received the following response from the DOJ: “We have prepared and hereby provide to you a draft ballot title for the above-referenced prospective initiative petition.”

As of today there are 16 Initiative Petitions filed for the 2024 election.

An Initiative Petition may be filed at any time. It puts a measure on a ballot.

A Referendum Petition refers a legislative action to the voters.

​A Referral is a resolution prepared by the governing body to place a question on the ballot for electors to decide. The referral is filed with the appropriate filing officer. The state governing body is the Legislature. Referrals are filed with the Oregon Secretary of State.
